TERMS AND CONDITIONS OF SERVICE

1. ACCEPTANCE OF TERMS

These Terms and Conditions of Service (“Terms”) constitute a legally binding agreement between Qadar Logistics LLC (“Company,” “we,” “us,” or “our”) and you, the user (“User,” “you,” or “Customer”). These Terms govern your access to and use of our website, qadarlogistics.com, and all related logistics services, including communication via phone, email, and Short Message Service (SMS) / Multimedia Messaging Service (MMS).
By engaging with Qadar Logistics LLC, requesting a freight quote, or providing your contact information, you agree to these Terms and our Privacy Policy.


2. SCOPE OF SERVICES

Qadar Logistics LLC is a third-party logistics provider and motor carrier authorized to facilitate the transportation of freight. Our services include, but are not limited to, freight brokerage, dispatch coordination, load tracking, and administrative support.


3. USER ELIGIBILITY AND ACCOUNTS

By using this website or our services, you represent that you are at least 18 years of age and have the legal authority to bind yourself or the entity you represent to these Terms. You agree to provide accurate, current, and complete information during any registration or inquiry process.


4. SMS/MMS MOBILE MESSAGING PROGRAM

Qadar Logistics LLC utilizes a mobile messaging program to provide real-time updates and facilitate business operations.

  • Express Consent: By submitting a contact form on qadarlogistics.com, providing your number in a carrier packet, or initiating a text to our business number, you provide express written consent to receive recurring automated and manual text messages (SMS and MMS) from Qadar Logistics LLC.

  • Use Case: Messaging will be used strictly for operational purposes, including but not limited to: Load status updates, Rate Confirmations, Pick-up/Delivery coordination, Dispatching instructions, and Billing inquiries.

  • Non-Marketing Guarantee: We do not utilize SMS for mass marketing or "spam" campaigns. Messaging is strictly limited to the scope of our business relationship.

  • Message & Data Rates: Standard message and data rates may apply from your wireless carrier. Qadar Logistics LLC is not responsible for any costs incurred by you or the person who has control of the mobile device.

  • Message Frequency: The number of messages you receive will vary based on the volume of active logistics transactions you have with us.


5. SMS OPT-OUT AND SUPPORT (STOP/HELP)

In compliance with CTIA and carrier regulations, we offer an immediate and automated way to end communications.

  • To Cancel: You may opt-out of our SMS program at any time. Text STOP to our number. After you send the message "STOP," we will send you a final SMS to confirm that you have been unsubscribed. No further messages will be sent unless you re-initiate contact.

  • To Get Help: If you have questions or require technical assistance, text HELP to our number or email info@qadarlogistics.com.

  • Carrier Liability: Mobile carriers are not liable for delayed or undelivered messages.


6. INTELLECTUAL PROPERTY RIGHTS

All content, trademarks, logos, and service marks displayed on qadarlogistics.com are the exclusive property of Qadar Logistics LLC. Unauthorized use, reproduction, or distribution of any materials on this site is strictly prohibited.


7. LIMITATION OF LIABILITY AND DISCLAIMER

  • Logistics Disclaimer: While we strive for 100% accuracy, Qadar Logistics LLC does not guarantee specific delivery times due to factors outside our control (e.g., weather, traffic, equipment failure).

  • Limitation: To the maximum extent permitted by law, Qadar Logistics LLC shall not be liable for any indirect, incidental, or consequential damages, including loss of profits or cargo value, arising from the use of our digital services or communications.


8. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Qadar Logistics LLC and its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms or your misuse of our messaging services.


9. PRIVACY INTEGRATION

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at qadarlogistics.com/privacy-policy to understand how we protect your data. We explicitly do not share SMS opt-in data with third parties for marketing purposes.


10. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any legal action arising from these Terms shall be filed exclusively in the state or federal courts located in Centre County, Pennsylvania.


11. MODIFICATIONS TO TERMS

We reserve the right to update these Terms at any time to reflect changes in carrier regulations or company policy. Your continued use of our Services after such changes constitutes acceptance of the new Terms.
